Terms and Conditions

Welcome to GameCrew! These Terms and Conditions (“Terms”) govern your access to and use of the GameCrew mobile application, website, and related services (collectively, the “App” or “Platform”) provided by GameCrew, LLC (“GameCrew,” “we,” “our,” or “us”).

By accessing or using GameCrew, you agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Eligibility

To create an account or use GameCrew, you must:

  • Be at least 18 years of age (or the age of majority in your jurisdiction, if higher);

  • Have the legal capacity and authority to enter into these Terms;

  • Agree to comply with all applicable federal, state, and local laws.

We reserve the right to verify eligibility and may suspend or terminate accounts that do not meet these requirements.

2. Account Registration and Security

  • You must provide accurate, current, and complete information during registration.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

  • You agree to immediately notify GameCrew of any unauthorized use of your account.

  • GameCrew is not liable for any loss or damage resulting from unauthorized account access caused by your failure to safeguard credentials.

3. User Responsibilities

By using the App, you agree to:

  • Use the Platform only for lawful and intended purposes;

  • Accurately represent your identity and intentions when creating or joining events;

  • Treat other users respectfully, both online and in person;

  • Comply with all applicable venue rules, laws, and regulations during events;

  • Assume full responsibility for your interactions, both online and offline.

4. Community Guidelines

GameCrew fosters a respectful, inclusive community. Prohibited conduct includes, but is not limited to:

  • Hate speech, harassment, bullying, or discriminatory behavior;

  • Sexually explicit, obscene, or violent content;

  • Stalking, intimidation, or threats;

  • Impersonation, misrepresentation, or creation of false accounts;

  • Spamming, phishing, scams, or unauthorized commercial activity;

  • Encouraging illegal or unsafe behavior (e.g., underage drinking, violence, drug use).

GameCrew reserves the right to remove content, issue warnings, or suspend/terminate accounts at its sole discretion.

5. Messaging and Social Features

GameCrew may allow private messaging, group chats, event discussions, and user connections. You agree not to:

  • Send unsolicited promotions, advertisements, or spam;

  • Share explicit, harmful, or misleading content;

  • Use messaging to harass, pressure, or coerce others.

GameCrew may monitor, restrict, or remove messaging privileges where necessary to enforce these Terms.

6. Event Creation and Participation

GameCrew allows users to host or join events. By creating or attending events, you agree:

  • You are solely responsible for your conduct and safety;

  • You must comply with all venue requirements, age restrictions, and applicable laws;

  • You will not promote unsafe, illegal, or harmful activities;

  • GameCrew does not supervise, endorse, or verify events—participation is entirely at your own risk.

7. Alcohol-Related and Public Events

Many events occur at bars, restaurants, or other venues serving alcohol. You acknowledge and agree that:

  • GameCrew does not encourage or promote excessive alcohol consumption;

  • You must be of legal drinking age in your jurisdiction;

  • You assume full responsibility for your choices, actions, and any resulting consequences;

  • GameCrew is not liable for incidents, injuries, or disputes arising from alcohol consumption or venue-related issues.

8. User Content

You retain ownership of any content you post (including text, images, or event listings). By posting, you grant GameCrew a non-exclusive, royalty-free, worldwide, perpetual, transferable license to:

  • Use, display, reproduce, adapt, and distribute your content for the operation, promotion, and improvement of the Platform.

You represent and warrant that you have all necessary rights to share content and that it does not infringe the rights of others.

GameCrew may remove or restrict content that violates these Terms or applicable law.

9. Termination and Suspension

We reserve the right, in our sole discretion, to suspend, restrict, or permanently terminate accounts with or without notice if you:

  • Violate these Terms or Community Guidelines;

  • Engage in unsafe, illegal, or harmful conduct;

  • Interfere with the proper operation of the Platform.

Termination does not limit GameCrew’s right to pursue other legal remedies.

10. Disclaimers

10.1 Platform Use at Your Own Risk

  • GameCrew does not conduct background checks on users.

  • We do not guarantee the accuracy, safety, or intent of any user or event.

  • You assume all risks associated with your interactions.

10.2 Events and Interactions

  • GameCrew does not host, supervise, or control events.

  • We are not responsible for disputes, injuries, property damage, or incidents that occur before, during, or after events.

10.3 Venues and Alcohol

  • GameCrew is not affiliated with third-party venues.

  • We disclaim liability for alcohol-related issues, venue policies, or incidents on premises.

10.4 App Performance
The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, GameCrew, its officers, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages;

  • Loss of profits, data, goodwill, or personal injury;

  • Issues arising from events, venues, user conduct, or third-party services.

In no event shall GameCrew’s total liability exceed $100 USD or the amount you paid to GameCrew in the last 12 months, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless GameCrew, LLC, and its affiliates, officers, employees, and contractors from any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from:

  • Your use of the Platform;

  • Your content, conduct, or participation in events;

  • Violation of these Terms or applicable law.

13. Privacy

Your use of the App is subject to our [Privacy Policy], which describes how we collect, use, and protect your personal data.

14. Intellectual Property

  • All trademarks, logos, and service marks displayed in the App are owned by GameCrew or its licensors.

  • You may not copy, distribute, modify, or use GameCrew’s branding without prior written consent.

15. Changes to These Terms

GameCrew may update these Terms at any time. Updates are effective upon posting within the App. Continued use constitutes acceptance of revised Terms.

16. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed under the laws of the State of Texas, without regard to conflict of law principles.

  • Any dispute shall be resolved exclusively in the state or federal courts located in Dallas County, Texas.

  • Users waive any right to a jury trial or class action participation.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and GameCrew, superseding all prior oral or written understandings.
